If you do not agree, do not use the Services. ## 1) Definitions “Content” means text, graphics, data, software, designs, and other materials made available through the Services. “User Content” means information you submit or generate through the Services (for example, the answers you provide to questions, preferences, and any notes you enter). “Decision Output” means any summary, comparison, scenario estimate, score, ranking, confidence label, or other output produced by the Services. ## 2) Eligibility You must be at least 18 years old to use the Services. By using the Services, you represent that you are legally able to enter into a binding agreement and that you will comply with these Terms. ## 3) Scope of the Services; non‑marketing decision support The Services provide consumer education and decision‑support regarding Medicare coverage choices, including Original Medicare, Medigap (Medicare Supplement), Medicare Advantage, Part D, Medicaid interactions, and related topics. The Services are not marketing or lead generation by default. We do not provide enrollment services, do not sell insurance, and do not act as your agent or broker through the Services. ## 4) Not professional advice; no reliance The Services are not a substitute for professional advice. Decision Outputs are generated based on assumptions and your inputs; they can be wrong, incomplete, or inapplicable to your circumstances. You agree that you will not rely solely on any Decision Output to make coverage decisions. **Before enrolling in, switching, canceling, or allowing coverage to lapse, you will independently verify the relevant facts and should consult a properly licensed insurance agent or producer in your jurisdiction.** Verification should include authoritative sources such as Medicare.gov, official plan documents, the carrier or plan, state SHIP resources when appropriate, and other qualified professionals as needed. Use of the Services does not create an insurance-agent, broker, fiduciary, attorney-client, clinician-patient, tax-advisor, or other professional relationship with Dark Star Consulting Group LLC. ## 5) No Blue Button / Medicare.gov account integration (current scope) The Services do **not** connect to Medicare.gov accounts and do **not** retrieve claims data via Blue Button or any Medicare claims API in the current version. Any references to “claims,” “spending,” or “utilization” within Decision Outputs are estimates or user‑provided summaries unless explicitly labeled otherwise. If we add claims import or account connections in the future, we will provide updated terms and request additional permissions as needed. ## 6) Accounts and local-first storage The current private-beta build does **not** require or provide a Coverage Compass user account. Questionnaire answers and report context are stored locally in the user's browser by default. If account or hosted-sync features are introduced later, these Terms and the Privacy Policy must be updated before those features are treated as part of the production service. ## 7) User Content; permissions; responsibilities You retain ownership of your User Content. In the current local-first build, Dark Star Consulting Group LLC does not receive questionnaire answers or report context by default. The App processes that information in the browser to generate Decision Outputs. If you intentionally export, print, copy, or later submit information through a support or hosted feature, that separate action may create a copy outside browser storage and will be governed by the disclosures applicable to that feature. You agree not to submit false, misleading, or fraudulent information, content that violates another person’s rights, content that contains malware or attempts to interfere with the Services, or sensitive identifiers you do not want stored (for example, Medicare Beneficiary Identifier or Social Security number) unless a feature explicitly requests it and clearly explains why. ## 8) Acceptable use; prohibited conduct You agree not to reverse engineer, scrape, or disrupt the Services; probe, scan, or test vulnerabilities except as authorized in writing; use the Services to violate any law or third‑party right; or use automated systems to access the Services in a way that materially degrades performance. We may suspend or terminate access for violations. ## 9) Content and intellectual property The Services, including our software, UI, designs, and Content, are owned by or licensed to us and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Services. ## 10) Third‑party services and links The Services may reference or link to third‑party resources (including government resources) for convenience. We do not control those resources and are not responsible for their content, availability, or practices. You agree not to treat a score, ranking, confidence label, report, script, checklist, or other Decision Output as a guarantee of any insurance, financial, medical, legal, tax, underwriting, enrollment, or coverage outcome. ## 14) Indemnification; enforcement costs To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Dark Star Consulting Group LLC and its affiliates, officers, directors, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses, including attorneys’ fees, arising from your misuse of the Services, unlawful conduct, User Content that violates another person’s rights, or material violation of these Terms. In any dispute or enforcement proceeding permitted under these Terms, the court or arbitrator may award the prevailing party reasonable attorneys’ fees and costs to the extent authorized by applicable law. You also agree that, to the extent permitted by law, Dark Star Consulting Group LLC may seek recovery of reasonable fees, costs, sanctions, and other available relief incurred responding to claims or proceedings determined by the court or arbitrator to be frivolous, abusive, brought in bad faith, or pursued in material violation of an enforceable dispute-resolution provision. The application code does not intentionally transmit questionnaire answers, report context, or recommendation results to Dark Star Consulting Group LLC by default. ### (a) Information you provide You may provide information such as age or age range, ZIP code or county/state, preferred doctors/hospitals (names you enter), health preferences and constraints, general health indicators or chronic conditions you choose to share (optional), budget ranges and financial preferences, and notes you type into the App. You should **not** enter sensitive identifiers such as a Medicare Beneficiary Identifier (MBI) or Social Security number unless a specific feature explicitly asks for it and explains the purpose. ### (b) Device and usage data The current application does not include an analytics or advertising SDK and does not intentionally collect cross-site tracking data. The web-hosting provider may process ordinary request metadata needed to deliver the static site, such as IP address, request time, and browser information, under the provider's own infrastructure and retention practices. ### (c) Browser storage Coverage Compass uses browser storage to save assessment progress, settings, report context, and private-beta report-access state. The current build does not use advertising or analytics cookies. ## 3) How information is used Questionnaire answers and report context are processed locally in the browser to calculate readiness, generate educational Decision Outputs, restore assessment progress, and create user-requested exports or printable packets. Dark Star Consulting Group LLC does not use those locally stored answers for marketing, lead generation, analytics, or advertising in the current private beta. ## 4) How information is shared Questionnaire answers and report content are not sent to a service provider by the App by default. Static hosting necessarily serves application files and may process ordinary web-request metadata. If the user intentionally exports, prints, copies, or later submits information through a support or hosted feature, that information leaves the local-only boundary at the user's direction. We may disclose information if we believe in good faith that disclosure is necessary to comply with law, protect rights and safety, prevent fraud, or respond to lawful requests. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to reasonable confidentiality protections. ## 5) Retention Assessment and report data stored by Coverage Compass in the browser remains on that device until the user resets the assessment, clears Coverage Compass local data, clears browser/site data, or the browser removes it. Hosting-provider operational logs, if any, follow the provider's retention practices. ## 6) Security We use administrative, technical, and organizational measures designed to protect information. No system is perfectly secure. Because the current build stores assessment information locally, users should protect access to their device and browser profile and should treat Full exports and printed packets as potentially sensitive. ## 7) Your choices and rights Depending on where you live, you may have rights to access, correct, delete, or port certain information, and to opt out of certain processing.
